Terms of Service for StreamSync

Welcome to StreamSync (“StreamSync,” “Service”). These Terms of Service (“Terms”) govern your access to and use of StreamSync, including any websites, panels, overlays, APIs, chat features, notification tools, and related services provided by OneStarLive LLC (“OneStarLive,” “we,” “us,” “our”).

By accessing or using StreamSync, you agree to these Terms. If you do not agree, do not use the Service.

1. Definitions

  • “Broadcaster” means a Twitch channel owner/operator using StreamSync to create, promote, or schedule Events.

  • “Viewer” means a user interacting with StreamSync on Twitch, a shareable event page, or other surfaces.

  • “Event” means any event created via StreamSync (including its title, description, goal, schedule, images, and metadata).

  • “Momentum” means a feature state where an Event is actively promoted during a live stream (including Start/Stop Momentum, overlay prompts, chat hype messages, temporary commands, and goal progress display).

  • “Vote Options / Outcomes” means optional interactive choices associated with an Event that may be shown to Viewers and may be influenced by Viewer interactions or Bits contributions (where enabled).

  • “Bits” means Twitch Bits and any related Twitch contributions mechanism.

2. Eligibility and Accounts

You must comply with all applicable laws and platform rules (including Twitch rules) to use StreamSync. You are responsible for:

  • safeguarding access to your Twitch account and any StreamSync authentication tokens;

  • all activity performed through your use of StreamSync; and

  • providing accurate information when requested.

We may suspend or terminate access at any time if we believe you violated these Terms or misused the Service.

3. Relationship to Twitch and Third Parties

StreamSync integrates with Twitch and may integrate with other third-party services (e.g., SMS providers). StreamSync is not affiliated with, endorsed by, or sponsored by Twitch.

Your use of Twitch and third-party services is governed by their own terms and policies. We are not responsible for third-party platforms, outages, feature changes, moderation actions, payment processing, or API limitations.

4. What StreamSync Does (Service Overview)

StreamSync provides tools that may include:

  • creating and displaying Events in channel panels and/or overlays;

  • activating Momentum during a live stream (Start/Stop Momentum);

  • automated or semi-automated chat hype messaging (where enabled);

  • temporary chat commands (e.g., !event) during Momentum (where enabled);

  • shareable event pages and sharing tools;

  • Bits goal progress tracking and goal state transitions (e.g., Goal Reached / Unlocked);

  • optional Vote Options / Outcomes attached to Events; and

  • scheduling tools after a goal is reached (where available).

StreamSync does not guarantee that any Event will reach its goal, be scheduled, occur on time, or occur at all.

5. Events, Momentum, and Vote Options

5.1 Broadcaster Controls and Discretion

Broadcasters control their Events. Broadcasters may create, modify, reschedule, pause, stop Momentum, or cancel Events at any time.

5.2 Momentum Features and Limitations

Momentum tools may depend on Twitch and third-party systems. StreamSync does not guarantee:

  • that overlay elements will display for all Viewers,

  • that chat messages or commands will function continuously,

  • that a specific volume of engagement or Bits will occur, or

  • that Twitch will allow a particular messaging behavior at all times.

5.3 Vote Options / Outcomes (Where Enabled)

Vote Options / Outcomes are an engagement feature and may reflect preferences, modifiers, or “what chat wants”—not a guaranteed deliverable. Unless a Broadcaster explicitly promises otherwise, votes do not create a contractual obligation to perform a specific outcome, cosplay, action, or content.

We do not guarantee that any voting mechanic will:

  • produce a single winner,

  • produce a result that is feasible,

  • reflect all Viewers (e.g., some may not see the feature), or

  • be free from edge cases, ties, or technical errors.

6. Bits, Payments, and No Refunds

6.1 Twitch Handles Transactions

StreamSync may display Bits progress and facilitate Event interactions, but all Bits transactions are processed by Twitch, not OneStarLive.

6.2 No Refunds (Critical)

All Bits contributions are final and non-refundable. StreamSync does not issue refunds, including for Events that:

  • do not reach the goal,

  • reach the goal but are not scheduled,

  • are scheduled but delayed, modified, or cancelled,

  • have technical issues (overlay/chat/votes),

  • have a result that is not feasible, or

  • do not occur for any reason.

By contributing Bits, you agree your transaction is subject to Twitch’s policies and that OneStarLive has no liability for disputes, reversals, chargebacks, or Twitch processing issues.

6.3 No Wagers / Gambling

StreamSync is not a gambling product. Bits contributions are voluntary platform interactions and do not represent a bet, wager, or guaranteed exchange of value.

7. No Obligation to Stream / No Broadcaster Performance Guarantee

Broadcasters are not obligated to stream any Event or deliver any specific content, even if a goal is reached or scheduling is unlocked.

StreamSync is a facilitation tool only. OneStarLive is not responsible for Broadcaster decisions, performance, attendance, delays, cancellations, quality, or safety.

8. Livestream Incidents and Content Responsibility

8.1 No Responsibility for Livestream Incidents

StreamSync does not control livestream content or conduct. We are not responsible for any incident or harm that may occur during or related to a stream, including bullying, harassment, hate speech, threats, scams, adult content, or illegal activity.

8.2 No Endorsement

StreamSync does not promote or endorse harmful, suspicious, illegal, or unsafe activity. Broadcasters and Viewers are solely responsible for their conduct and content.

9. Communications, Chat Messages, and Temporary Commands

StreamSync may enable chat hype messages, reminders, and temporary commands (like !event) during Momentum. These features may be configurable and may be limited, throttled, blocked, or disabled by Twitch or other third parties at any time.

You acknowledge that:

  • chat messaging may fail, be delayed, or be disallowed by platform rules;

  • StreamSync is not responsible for chat moderation outcomes or enforcement actions; and

  • you remain responsible for ensuring your channel content and messaging complies with Twitch rules and applicable laws.

10. SMS / Notifications (Optional Opt-In)

If you opt in to receive notifications (including SMS), you consent to receive messages related to StreamSync Events (e.g., confirmations, reminders, and go-live notices), depending on what features are enabled and your opt-in selections.

  • Message frequency may vary.

  • Message and data rates may apply.

  • You can opt out at any time by following the instructions in the messages (e.g., replying “STOP”).

  • We may use third-party providers to deliver notifications.

  • Notifications are not guaranteed and may be delayed or fail.

You represent that you have the right to provide any phone number you submit and that you have the account holder’s consent where required.

11. User Content and Permissions

You may submit content such as Event titles, descriptions, images, links, and other materials (“User Content”). You grant OneStarLive a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute User Content solely to operate and improve StreamSync and to display your Events across StreamSync surfaces (including shareable event pages).

You are responsible for ensuring you have all rights to User Content and that it does not infringe third-party rights.

12. Prohibited Conduct

You agree not to:

  • violate any law, Twitch rule, or third-party right;

  • use StreamSync to promote harassment, doxxing, scams, or illegal activity;

  • interfere with, disrupt, exploit, scrape, or attempt unauthorized access to the Service;

  • reverse engineer or attempt to extract source code (except where prohibited by law).

13. Termination and Feature Changes

We may modify, suspend, or discontinue any part of StreamSync at any time (including Momentum features, chat tools, vote mechanics, or scheduling flows). We may suspend or terminate access if we believe you violated these Terms or used StreamSync in a harmful or abusive way.

14. Disclaimer of Warranties

StreamSync is provided “AS IS” and “AS AVAILABLE.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that StreamSync will be uninterrupted, error-free, secure, or compatible with all devices, overlays, or Twitch changes.

15. Limitation of Liability (Strong)

To the fullest extent permitted by law, OneStarLive LLC and StreamSync will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or any loss of profits, revenue, data, goodwill, or business opportunity.

To the fullest extent permitted by law, our total liability for any claim related to StreamSync will not exceed the greater of:

  • $100 USD, or

  • the amount you paid OneStarLive directly (if any) for the Service in the 12 months before the claim arose.

This limitation applies even if we were advised of the possibility of such damages.

(Some jurisdictions do not allow certain limitations; in that case, liability will be limited to the maximum extent permitted.)

16. Indemnification

You agree to indemnify and hold harmless OneStarLive LLC from any claims, damages, losses, liabilities, and expenses (including attorneys’ fees) arising out of or related to:

  • your use of StreamSync,

  • your Events, content, or conduct,

  • your violation of these Terms, or

  • your violation of any law, Twitch rule, or third-party right.

17. Dispute Resolution, Arbitration, and Class Action Waiver (Highly Protective)

PLEASE READ CAREFULLY — THIS AFFECTS YOUR RIGHTS.

17.1 Informal Resolution First

Before filing a claim, you agree to contact us at contact@onestarlive.com with a brief description of the issue and allow 30 days for us to attempt resolution.

17.2 Binding Arbitration

If not resolved, you and OneStarLive agree to resolve disputes through binding arbitration, except either party may bring claims in small claims court if eligible.

17.3 No Class Actions

You and OneStarLive agree that claims must be brought in an individual capacity only, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

(Arbitration specifics like provider/venue/rules should be reviewed by counsel to match your preferred setup.)

18. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

19. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms and revise the “Last updated” date. Continued use of StreamSync after changes means you accept the updated Terms.
